Too many would like to challenge the Obama critics as racist without looking at some of the complaints being registered. Two recent moves by Obama Administration Officials should be of concern to all of us.
The Obama Administration has demonstrated a willingness to assassinate citizens abroad if it felt they were acting as terrorist against our government. The most vivid example is the Obama ordered April 2010 targeted killing of Anwar al-Awlaki with alleged al-Quaeda ties who reportedly called for a jihad against his native USA and was felt to have had a hand in the training of the 9/11 bombers as well as other attacks aimed at the US. Speaking on March 6, 2012 before Chicago’s Northwestern University Law, US Attorney General Eric Holder defended the legality of targeted killings of U. S. Citizens abroad with terrorist ties and seemed mute when asked if such by extension could be done against citizens residing in the United States? Does anyone remember what happened to the Black Panthers in Chicago who were shot while they slept without benefit of their 4th and 6th Amendment Constitutional rights?
The 4th Amendment to the Constitution: “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”
The 6th Amendment defines the rights of U.S. citizens accused under the law -- “In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.”
Walter B. Jones, Jr. 3rd District Congressman from North Carolina has reportedly recently introduced House Concurrent Resolution 107 declaring that if Obama uses offensive military force without authorization of an act of Congress he should be impeached. This followed on the heels of March 7, 2012 statements attributed to Secretary of Defense Leon Panetta by former U. S. Colorado Congressional Representative Tom Tancredo “This week it was Secretary of Defense Panetta’s declaration before the Senate Armed Services Committee that he and President Obama look not to the Congress for authorization to bomb Syria but to NATO and the United Nations.” Such an action would not only be a clear violation of the US Constitution but would undermine the sovereignty of the US in allowing others to determine this nation’s cause of action.
Article I, Section 8, of the Constitution – “To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water;” –this section of the Constitution reserves to Congress the power to declare war. This congressional power increasingly is infringed upon by eager Presidents coupled with a Congress increasingly unwilling to do its job. This is allowing the amassing of a seemingly disproportionate amounts of power in the Executive Branch of government which undermines the constitutional concept of the balance of power between the triumvirate branches of government—Executive, Legislative and Judicial.
Every citizen should read and keep near a copy of the US Constitution. Learn it and be very afraid when people convince us that it doesn’t mean what it says.
